1. General Provisions
These Terms of Use (hereinafter referred to as the “Agreement”) constitute a public offer in accordance with Article 437 of the Civil Code of the Russian Federation.

By using the Service, the User confirms their agreement with the terms of this Agreement.
If the User does not agree with the terms of this Agreement, the User must stop using the Service.
The User agrees to independently monitor any changes to this Agreement. Continued use of the Service means acceptance of any changes made.

2. Service Description
Hanziway is an online service for creating and using educational materials for learning the Chinese language.
The Service provides the ability to:
● create educational materials
● use ready-made materials
● access paid content
● use tools for preparing lessons
The Service is provided via the Internet under a SaaS (Software as a Service) model.
The materials of the Service, including text, graphics, images, generated writing worksheets, and other materials contained in the Service (hereinafter referred to as the “Materials”), are educational and informational in nature and are intended for independent use by the User.
The Operator has the right to change the functionality of the Service, suspend or terminate its operation at any time without prior notice.

3. Registration
To use the functionality of the Service, the User may create an account.
The User agrees to:
● provide accurate information
● not transfer access to the account to third parties
● ensure the security of login credentials
The User is responsible for all actions performed through their account.
The rules regarding the collection and use of the User’s personal information are set out in the Privacy Policy available at: https://hanziway.com/ru/content/2-policy
To use the full functionality of the Service, the User must register, confirm their email address by following the link specified in the validation email from the Service, and create a User profile (hereinafter referred to as the “Profile”).
The Service is governed by the laws of the Russian Federation. Those who access the Service from other countries and continents do so on their own initiative and are responsible for complying with local laws. We reserve the right to restrict access to the Service for any person at any time at our sole discretion.

4. Paid Services
The Service may provide paid access to its functionality.
The following subscription plans are available:
● 1-day subscription
● 1-month subscription
● 1-year subscription
The price, subscription period, and available payment methods are displayed on the Service payment page.
After payment, the User receives access to the functionality of the Service for the subscription period. If a payment method requiring manual verification is used, access is provided after the Operator confirms receipt of the payment.
The subscription grants the right to access the Service and does not transfer ownership rights to any content.
The Operator has the right to use external payment services and/or payment partners to accept and process payments.
For Users who do not have access to the standard payment methods available on the website, the Service may provide the option to pay for access in US dollars using an external payment link and/or the Operator’s payment partner.
Payments in US dollars are processed manually. After making a payment, the User must submit a payment verification request through the Service interface.
Access to PRO status is provided only after the Operator confirms receipt of the payment. Payment verification may take up to 8 hours.
Until the payment is confirmed, PRO status is not considered activated.
If the payment is not found or cannot be matched with the User’s payment request, the Operator has the right to request additional information from the User that is necessary to verify the payment.
In the event of an incorrect, duplicate, or disputed payment, the User must contact support at hanziway@yandex.ru and provide the account email address, selected subscription plan, payment amount, payment currency, and approximate payment time.
Refunds are reviewed on an individual basis. A refund may be impossible or limited if PRO status has already been granted and the User has started using the paid functionality of the Service.

4.1. Extended License
The Service may provide the User with an extended license for a period of 1 (one) year.
The extended license grants the right to:
● use the functionality of the Service without limitations during the paid period
● use the Service under the User’s own brand (white-label)
● use the Service materials in educational and commercial activities
The extended license does not grant the right to:
● resell access to the Service
● transfer access to third parties
● create similar services
● copy the software or database
All rights to the Service belong to the Operator.
The Operator has the right to revoke the license in case of violation of this Agreement.
Use of the Service under the User’s own brand does not constitute a transfer of exclusive rights to the Service.

5. Digital Services
The User agrees that the Service provides digital content.
Access to the Service is provided immediately after payment. If a payment method requiring manual verification is used, access to the Service is provided after the Operator confirms the payment.
After the User starts using the Service, refunds may be limited in accordance with the laws of the Russian Federation.

6. Moment of Service Delivery
The service is considered delivered from the moment access to the functionality of the Service is provided.
For payments that require manual verification, the service is considered delivered from the moment the corresponding paid access is activated after the Operator confirms the payment.
From that moment, the service is considered duly and fully provided.

7. Intellectual Property
All elements of the Service are objects of intellectual property.
It is prohibited to:
● copy materials
● distribute materials
● use them for commercial purposes without permission
● use the Service to train neural networks
● extract data to create databases or similar services
The Service database is protected by the laws of the Russian Federation.

No part of the Service may be reproduced or transmitted to any person in any form or by any means, electronic or mechanical, including photocopying and recording, except under the following conditions:

- The Materials of the Service may be used solely for non-commercial, informational purposes;
- The materials may be used in kindergartens, schools, individual classes, and by tutors in the process of teaching children, etc.
It is not permitted to modify the content or remove trademarks, copyright notices, or other proprietary notices.
Modification of the content or use of the content for any purposes other than personal non-commercial use constitutes a violation of copyright and other proprietary rights and may result in legal liability.

8. User Content
The User may create materials within the Service.
By posting content, the User grants the Operator a non-exclusive license to use such content within the Service.
The User guarantees that they have the rights to post the materials.

9. Responsibility for User Content
The User is fully responsible for the content they create.
The User guarantees that the content:
● does not violate the laws of the Russian Federation
● does not violate the rights of third parties
● is accurate
The Operator is not the author, editor, or moderator of user content. The Operator is not responsible for:
● the content of materials
● the accuracy of information
● the educational value of materials
The User agrees to resolve any claims from third parties independently.
If any claims are brought against the Operator by third parties in connection with user content, the User agrees to compensate the Operator for all losses.

10. Usage Restrictions
The User is prohibited from:
● using bots and scripts
● performing mass data collection
● copying the database
● obtaining unauthorized access
● extracting data to create similar services

11. Limitation of Liability
The Service is provided “as is”.
The Operator is not responsible for:
● technical failures
● actions of users
● results of using the materials
● delays caused by manual payment verification, external payment services, banks, or payment partners
The Operator’s maximum liability is limited to the amount paid by the User for the last 30 days of using the Service.

12. Personal Data
Data processing is carried out in accordance with the Privacy Policy.
For the purpose of recording and verifying payments, the Operator may process data related to the User’s payment request, including the selected subscription plan, payment amount, payment currency, date and time of the payment request, status of the payment request, and the fact that a payment verification request was submitted.

13. Changes to the Agreement
The Operator has the right to change the terms of this Agreement.
The current version is published on the website.
